Tech Professional from America Files Lawsuit Against TCS Alleging Preference for Indian Employees

The 61-year-old American Randy Devorin has begun legal action against the tech behemoth, accusing it of discriminatory hiring practices. Devorin has worked for Tata Consultancy Services (TCS) for over 10 years in the worldwide consulting business.

Devorin has filed a complaint in a US court alleging that TCS shows bias towards elder American employees and favours the termination of "freshers" and H-1B visa holders of Indian or South Asian heritage. When it comes to these allegations of prejudice, he wants a jury trial.

The complaint states that in July, Devorin was informed that his team was being dissolved and told to seek for a consultant post on a project alone. No matter how many times Devorin tried, through emails and applications, nothing came of it. The resource management team is obstructive, he says. No offers were made to Devorin, but a younger Indian coworker got a job and several promotions in no time.

The case highlights the fact that three of the fourteen global managing partners from India were reassigned to different positions after being laid off, while the remaining eleven were not retained. As stated in the Wall Street Journal, this legal action is a response to 22 worker complaints that have been filed with the Equal Employment Opportunity Commission (EEOC) since late December. These seasoned American experts claim that TCS fired them without warning and hired Indian nationals on H-1B visas to fill their positions.
